Hi there, sorry for the confusion caused. The TOS aren't final yet and actually weren't supposed to be linked anywhere. Obviously, in their current state they would be unacceptable for a diary, we are aware of that. As for your guesses regarding Wordpress, you guessed wrong. This is a completely separate thing.
