I suspect that's exactly the argument the government will make when a warrant canary case eventually makes its way to court. That taken to its logical conclusion it renders all gag orders ineffective. The EFF has a nice FAQ on warrant canaries: https://www.eff.org/deeplinks/2014/04/warrant-canary-faq But the short version is nobody really knows if you could be forced to post one or not. |
