Not as part of a domestic police action (Posse Comitatus), and under the constraint of at least directing it against enemy combatants & regulars (conventions of international warfare). Now, if either of those two are violated the calculus changes, and I leave it as an exercise to the student to decide which side one's sympathies should lay with.
