In current system if you do not do actual straight up criminal fraud you get charged for you get to keep all the money you got on the way. So even if math never makes sense there is money to be earned for the time being. And then when it fails, well there is always the next scheme. And next round of people who believe they can extract their share on the way.

Where is the fraud? Genuine; please help.
Say promises about AGI. I would expect company to show extensive theoretical work with error bars and such exactly when they can deliver it. And if sufficiently proven for that work to be incorrect or over promising in slightest to fully pay back investors for any losses.
Saying you're hoping to develop some tech that hasn't been done before isn't actually fraud. Everyone knows it's uncertain as to timing and if they'll be able to do it.
