If your theory is that it’s a first amendment violation, then it’s irrelevant whether it’s a law passed by congress or an executive order. It is well established that the government is allowed to make value judgments in deciding what activities to support with discretionary grants: https://firstamendment.mtsu.edu/article/government-funding-a...
