Where in the Constitution does it say a declaration of war is required to wage war? We didn't have a literal declaration of war for the Quasi War (1798-1800), the First Barbary War (1801–1805), the Second Barbary War (1815), any of the many American Indian wars, etc. That clearly didn't seem to be a sticking point for George Washington, John Adams, Thomas Jefferson or James Madison. |
