You see this blatantly abused all the time already - real example, first site I tested:

  Use limited data to select advertising
    Consent (91 vendors)
    Legitimate interest (41 vendors)
  Measure advertising performance
    Consent (97 vendors)
    Legitimate interest (58 vendors)

Which shouldn't be just finable but jailable.
