The spirit of the Bill of Rights is to restrict primarily the Federal government. The First Amendment didn't even apply to states (let alone businesses) until after we had a civil war, the Fourteenth Amendment, and a SCOTUS case in 1925 (https://en.wikipedia.org/wiki/Gitlow_v._New_York / https://en.wikipedia.org/wiki/Incorporation_of_the_Bill_of_R...). They had no intention of broadly protecting free speech in general.
