| Democracy in Korea at a Crossroad On December 3, 2024, at 10:27 PM, President Yoon Seokyeol declared martial law. This declaration is illegal and constitutes a criminal act, directly violating the Constitution and other laws. It is essentially a coup d'état. The current political and social situation does not meet the criteria of "a time when it is necessary to respond to military needs or maintain public order in wartime or a similar national emergency" as outlined in Article 77 of the Constitution. Therefore, the emergency martial law is invalid and illegal, and the president should be held accountable.
Additionally, martial law is procedurally invalid as there was no cabinet meeting, which is required by Article 2(5) of the Martial Law Act.
