It certainly is, because the laws are passed with the intent that they won't be applied equally. Incidentally, this is one of the things critical race theory actually talked about: how laws can be non-discriminatory on the surface, but deliberately created and applied in a discriminatory manner. To trot out Wilhoit's Law again: "Conservatism consists of exactly one proposition, to wit: There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect." |
