Actually, the side effects of allowing unelected Reg agencies to make decisions (and the quality of those decisions to date) is exactly what is driving their decision. Congress being parsimonious with laws is probably a good thing...read their Stare decisis paragraphs. Here is the decision for you to read, in case you hadn't yet read it before posting.
