IDK if it's very common but it happens, especially at smaller companies who either don't know the rules or those who have gotten away with it in the past and think they are too small to get noticed. Just recently here a restaurant was fined for not paying overtime by employing dishwashers and kitchen staff as "salaried" exempt employees. At large companies with in-house legal and HR teams? It probably doesn't happen much, but even there they will know what they can get away with. |
