As I said, caselaw and legislation grant rights not explicitly in the constitution. That's just a fact, and I'm not really interested in debating it or any various fringe theories of how some people think things ought to work, anymore than I have an interest in debating Pangaea existed or that the sky during daylight generally appears blue to humans.
