Wouldn't he be able to recover the costs for complying with the subpoena under Cal. Evidence Code section 1563? "All reasonable costs incurred in a civil proceeding by a witness who is not a party with respect to the production of all or any part of business records requested pursuant to a subpoena duces tecum shall be charged against the party serving the subpoena duces tecum."
