No because there is a game and the game is the main reason to own them; appreciation of value of rare cards is a by product and not the designed intent or the main reason to buy cards. If Pokémon was marketed as “hey buy these cards they will be worth more tomorrow” (actual or implied marketing) then you could make that argument, which has gotten those NFT “games” into trouble with the SEC. |
