Lawrence Lessig has argued that fair use is not serving its intended purpose: "In theory, fair use means you need no permission... But in practice, fair use functions very differently. The fuzzy lines of the law, tied to the extraordinary liability if lines are crossed, means that the effective fair use for many types of creators is slight." So yes, it's available to people/organizations with deep pockets (like The Daily Show), but the majority of people take on considerable risk when they try to leverage it. |
