They didn't pay for it--someone (probably Bubba the Love Sponge) anonymously sent them the footage. He was legally able to record his own home.

Florida is a two-party consent state. Everyone featured in a recording not happening in public must consent to being recorded. Both Hogan and Heather claim they didn't know.

Ok, well same thing. Hogan was invited over to have sex with Bubba's wife and Bubba secretly filmed it and sent it to a media company.
