I strongly disagree with your analysis. The rhetoric and much practice in the US has been that we have rights to do things unless taken away by new laws. You could smoke pot until the us govt made it illegal, for instance. Abortion was a common practice in the 1700s, notable for being mentioned with specific methods in Ben Franklin's book on common practices.

Yes and because there is no law banning abortion at the federal level, you are free to get one unless your state or local government has a law restricting it. This is the system working as intended.
