Yup. I work with MRI data. When de-identifying brain scans we have to strip the face off [0] because that's easily identifiable.

Perhaps they mean it skirts current privacy rules through legislative technicality.
Good point. In that case, legislation can be amended to close previously-invisible loopholes.
