As much as I’d like them not to lose, they are going to have a hard time here, since they basically disassembled the whole game and posted it on GitHub.

Wasn't the same done with Mario 64? Nintendo is the most litigious game company and they couldn't/haven't done anything about it. But then again I believe someone on here said they was a difference between how the two are done.
Is there more information about this, in particular?

so that's not a good idea, but being able to post your own patch code as well as patch instructions should be protected, IMO.
Yes, it should be protected as they are the ones that did it to themselves.
