A) that would be clever, and if the bad guys are that clever, they will easily find another way to share their stuff. B) apple could simply make a policy that your Icloud will trigger a scan / review after x devices are logged into it within a certain amount of time, in order to make sure you aren't using Icloud as a distribution platform for something. This whole scanning locally on device wouldn't be necessary.
