Only pre-release is covered. Post-release is not attacked in this bill:

That is from the definitions part of the document, which defines what "work being prepared for commercial public performance" means.

3 years for released works.

5 years for unreleased stuff.

So it's not just for pre-release. Pre-release just gives you an additional 2 years in prison!
