The key legal difference is that VW literally behaved differently if a test was running. If they had simply designed a system that tested better than it actually performed (by optimizing the factors tested for), they would not have gotten in trouble. If the water heater manufacturer had special heating elements that only ran during the test, it would be equivalent. |
