I‘d guess that the german „Sachmangel“ would apply here. However, this law applies to the seller - so every dealer would have to start arguing with WD about getting their money back. Sachmangel does not apply to the same extent for business customers...

IANAL but doesn't sachmangel require the seller to know about the drives being SMR when the purchase happens?
