Iunno, if you gave it to someone and don’t know where it is, the mental gymnastics to check the “Lost” box isn’t too difficult.

But I think they usually ask you to describe the circumstances of its loss.

I'm pretty sure the government who seized your passport won't look kindly upon you pretending you forgot you aren't allowed to have one.
Only if you're caught. Considering that the only reason you'd even attempt this would be to escape, your only concern would be not being able to return.
