Assuming that the court rules in the way I would want then 100% yes. WINE would be fair use because it’s purpose is to allow programs written for Windows to run on Linux. Google’s use of the Java API would be infringement because Google’s use of the API is to provide a familiar environment for Java developers and it was easier to borrow the Java API than design a new one. |
