The likelyhood is being caught may be the metric that determines the effectiveness of a deterrent over the severity of the punishment, but being caught implies that there is at least some negative consequence. So in order to be a deterrent there must be punishment. Increasing the severity will do little to increase the effectiveness, but increasing the likelyhood of getting caught will. |
