Actually, I think you're the one that's incorrect here. California can set a higher minimum wage because it's explicitly allowed to by 29 U.S. Code ยง 218. https://www.law.cornell.edu/uscode/text/29/218 That's an exception that's written into the law, while federal preemption is the usual rule. |
