Importantly, though, intent isn't required to make a discrimination claim under the Civil Rights Act. If a policy is apparently neutral, but it has a disproportionally negative impact on a protected class, it is illegal: https://en.wikipedia.org/wiki/Disparate_impact IBM's lawyers are surely aware of this. This is likely going to be painful for them and they did it anyway knowing the liability. |
