It's the flip side to preventing what they called "Tyranny of the Majority", if my freshman polisci memory from many moons ago is accurate. Imagine a scenario where the states wanted to make abortion illegal. We would want that decision scrutinized vs making a change to the law simply because a majority wanted it. |
