The $2.13 number is the minimum an employer has to pay to tipped employees. If the amount of tips plus $2.13 is less than the federal minimum wage of $7.25, the employer must make up the difference: https://www.dol.gov/whd/regs/compliance/posters/minwage.pdf I don't believe the California minimum wage law has tip credit. |
