Is your idea related to the business you currently work at? If not, just build it.

My employment agreement at last three companies says they own any intellectual property I create on or off business hours with or without using company equipment. Whether or not its related to the current business.
Not a lawyer, but certainly sounds overbearing and probably not enforceable.

Definitely you should talk to a lawyer. If your employer is going to take it, why bother? If not, go for it!
The question is how do you determine if it is related?
That's basically impossible if you work at a large company that does a lot of stuff. Most of the time they'll be working on a bunch of confidential projects that nobody knows about :'(
