No, they are not. Read the pre-amble to the bill of rights. It makes it clear the rights are broad and pre-existing for the Bill of Rights and the Bill of Rights merely clarifies. This is why the right to self defense cannot be restricted by any interpretation of the second amendment. Same with speech and the first amendment. Those amendments are restrictions on government, not creators of rights. |
