Jails are for short-term stays, i.e., defendants at any pre-trial stage (including pre-arraignment), and misdemeanor defendants that are serving sentences of 1 year or less. Prisons are for felony defendants that are serving sentences of more than 1 year, though in many cases prisoners that are sentenced to less than 2 years end up serving their time in jail due to overcrowding in the prisons. |
